? about SSI benefits ?

My sister's husband is disabled. Bad car accident, left him with emotional/mental issues. head inj. He gets SSI, Medicare, RX cov & foodstamps. This was about 6 years ago. At the time they were seperated & he listed his address under his brother. He was approved. Well they have tried to reconcile so many times I've lost count b.c they have a son. Don't get me started there. But when he called the SSI they said he would lose his benefits if he moved back in with his wife eventhough his brother makes 3x what my sister makes ? I don't get it. Nothing is fraudulent, he sees his physciatrist, his neuro, takes his meds & really can't function otherwise but they would take away his benefits if he moved in with his wife and child ? I don't get it & my brother-in-law is scared to rock the boat & lose his help because without the medical insurance and prescription cov he would probably commit suicide. My sister is terrified that they will get caught if he moves in & would be commiting fraud ?

The reason that they would take away his benefits is because she is his legal wife and legally responsible to take care of him. His brother is his brother but not legally responsible to take care of him. So if he were to move back with his wife and child her income would be taken into consideration as to what benefits that he qualifys for. Living with his brother who is not legally responsible for him, his income is not taken into cosideration to qualify for benefits. Hope that makes sense
